1) Acceptance
These Terms of Service (“Terms”) are a legally binding agreement between you and Mooni Team (“we”, “us”, “our”) governing your access to and use of the Mooni mobile application and related services (collectively, the “Service”).
2) Eligibility (17+)
The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
3) The Service
Mooni transforms your screenshots into engaging conversations with AI-generated replies. Simply upload your chat images and provide personality details to receive personalized responses.
AI-generated content may be inaccurate, incomplete, or inappropriate.
You decide how to use, share, or rely on the outputs.
The Service is provided for entertainment and productivity purposes and is not professional advice.
4) Accounts
- Provide accurate information (such as name, username, and email)
- Maintain and update your account information
- Keep your login credentials secure
- Notify us promptly if you suspect unauthorized access
You are responsible for activity that occurs under your account, unless prohibited by applicable law.
5) User Content and Permissions
5.1 Your Content
“User Content” means any content you submit through the Service, including chat screenshots/images, text prompts, personality details, feedback, and support messages. You represent and warrant that you have the necessary rights to upload your User Content and that it does not violate law or third-party rights.
5.2 License to Operate the Service
You grant Mooni Team a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display your User Content solely to operate, provide, and improve the Service and to generate the outputs you request.
5.3 AI Processing and Deletion
If you choose to upload images or text for AI features, that content is processed on Mooni Team’s own servers and deleted immediately after processing is completed, subject only to short-lived technical buffering required to complete the request reliably.
5.4 No Biometric Identification
We do not perform facial recognition or biometric identification on photos you upload.
6) Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, fraudulent, or abusive purposes
- Upload content that infringes intellectual property, privacy, or other rights
- Upload content that is hateful, harassing, sexually explicit, or otherwise objectionable
- Reverse engineer, interfere with, disrupt, or gain unauthorized access to the Service
- Use automated means in a way that impairs the Service (e.g., scraping, bots, denial-of-service activity)
- Circumvent or bypass security or access controls
We may remove content or restrict access if we reasonably believe it violates these Terms or creates risk for users or Mooni Team.
7) Intellectual Property
The Service, including its software, design, and trademarks, is owned by Mooni Team or its licensors and is protected by applicable intellectual property laws. Except for the limited rights granted to you, no rights are transferred under these Terms.
8) Third-Party Services
The Service may include or interact with third-party services or content. Mooni Team is not responsible for third-party services, and your use of them may be governed by their own terms and policies.
9) Fees and Purchases (If Any)
If the Service offers paid features, pricing and purchase terms will be presented at the time of purchase. Purchases on iOS are generally handled through Apple’s in-app purchase system and are subject to Apple’s terms and policies.
10) Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONI TEAM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE.
11) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONI TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONI TEAM’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO MOONI TEAM FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $10 IF YOU PAID NOTHING.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Mooni Team from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
13) Termination
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk, or used the Service unlawfully. Upon termination, your right to use the Service will cease.
14) Changes to the Service or Terms
We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. If we make changes, we will update the “Effective Date.” Your continued use after the updated effective date means you accept the updated Terms.
15) Governing Law
These Terms are governed by the laws of the jurisdiction where Mooni Team’s principal place of business is located, without regard to conflict of laws principles, except where applicable law requires otherwise.
16) Dispute Resolution; Binding Arbitration
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration rather than in court. Arbitration will be conducted on an individual basis; class or representative actions are not permitted to the maximum extent allowed by law.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent unauthorized use of the Service.
